1. Agreement to Terms
By purchasing or using services from Hopeful Writing ("we," "us," or "our"), you ("Client" or "you") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Services Offered
2.1 Document Review Service
Our standard document review service includes:

Up to 60 minutes of expert review and analysis of your submitted document

Written feedback provided through annotations directly on your source document

One 30-minute virtual consultation session to discuss the feedback
2.2 Subscription Services

We offer monthly subscription plans that bundle multiple document reviews. Subscription details, including the number of reviews included and pricing, are specified at the time of purchase.
3. Service Limitations
3.1 One-Time Review Policy
Each document will be reviewed only once. We do not provide multiple reviews or revisions of the same document. If you require additional feedback on a revised version of a previously reviewed document, this will be considered a new document review and will require a separate purchase or use of another review credit from your subscription.
3.2 Subscription Usage

Subscription benefits are valid only during the active monthly period

Unused document reviews do NOT roll over to subsequent months

All reviews included in a monthly subscription must be used within that calendar month or they will expire

Subscription renewals begin a new monthly period with the full allotment of reviews as specified in your plan
4. Document Submission Requirements
4.1 Acceptable Formats
Documents must be submitted in commonly accessible, editable formats (e.g., .docx, .txt). We reserve the right to refuse documents in formats we cannot reasonably review.

4.2 Document Length and Scope
Any limitations on document length, word count, or subject matter will be clearly communicated at the time of service purchase. Documents exceeding specified limits may be subject to additional fees or may be returned unreviewed.
4.3 Submission Deadline
Clients must submit documents within any specified timeframe associated with their purchase. Failure to submit within the designated period may result in forfeiture of the service.
5. Scheduling and Consultation Sessions
5.1 Scheduling
The 30-minute virtual consultation must be scheduled within 10 days of document review completion. Failure to schedule within this period may result in forfeiture of the consultation session.
5.2 Rescheduling and Cancellations

Clients may reschedule consultation sessions with at least 24 hours' notice

Late cancellations (less than 24 hours) or no-shows will be considered completed sessions and will not be rescheduled

We reserve the right to reschedule sessions due to unforeseen circumstances, and will work with you to find an alternative time
6. Payment Terms
6.1 Pricing
All prices are stated in USD and are subject to change. Current pricing will be displayed on our website at the time of purchase.
6.2 Payment Methods
We accept credit cards and most digital payment systems. Payment is required in full at the time of purchase.
6.3 Subscription Billing

Subscriptions are billed monthly on a recurring basis

Billing occurs on the same day each month as your initial subscription date

You authorize us to charge your payment method for each billing cycle until you cancel

6.4 Failed Payments
If a subscription payment fails, we will attempt to notify you and may suspend your service until payment is received. Continued payment failures may result in subscription cancellation.
7. Refund and Cancellation Policy
7.1 One-Time Review Services

Refunds for one-time document review services may be requested before we begin reviewing your document

Once review work has commenced, no refunds will be provided

Refunds are not available after the document has been annotated or the consultation session has occurred
7.2 Subscription Cancellations

You may cancel your subscription at any time

Cancellations take effect at the end of the current billing cycle

No refunds will be provided for partial months

You retain access to remaining reviews in your current subscription period through the end of that billing cycle
7.3 Refund Processing
Approved refunds will be processed within 10 business days to the original payment method.
8. Intellectual Property
8.1 Client Content
You retain all rights to your submitted documents. By submitting a document for review, you grant us a limited license to review, annotate, and provide feedback on the document solely for the purpose of delivering our services.
8.2 Feedback and Annotations
While you retain ownership of your original document, the feedback, annotations, and consultation provided by us constitute our intellectual property. You may use this feedback for your personal or business purposes related to improving your document, but you may not resell, redistribute, or repurpose our feedback as a standalone product or service.
8.3 Confidentiality
We will not share your documents or the feedback we provide with third parties without your explicit consent, except as required by law.
9. Limitation of Liability
9.1 Service Limitations
Our services provide professional feedback and guidance on writing and documentation. We do not guarantee:

Acceptance of your document by any third party

Achievement of any specific outcome

Error-free feedback (though we strive for accuracy)
9.2 Professional Opinion Disclaimer
All feedback, recommendations, and guidance provided through our services represent our professional opinion only. Writing and communication are subjective fields, and what works in one context may not work in another. You are solely responsible for determining whether and how to implement our suggestions. We are not liable for any outcomes resulting from your use or non-use of our feedback, including but not limited to rejection of documents, unfavorable reviews, business losses, or any other consequences.
9.3 Liability Cap
To the maximum extent permitted by law, our total liability for any claims related to our services shall not exceed the amount you paid for the specific service giving rise to the claim.
9.4 No Consequential Damages
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
10. Client Responsibilities
You agree to:

Provide accurate contact information

Submit documents by specified deadlines

Attend scheduled consultation sessions or provide adequate notice for rescheduling

Ensure you have the right to submit any documents you provide for review

Not submit documents containing illegal content or content that violates third-party rights
11. Prohibited Uses
You may not:

Submit documents for review that you do not have the right to share

Use our services to violate any applicable laws or regulations

Submit malicious files or content intended to harm our systems

Misrepresent your identity or impersonate others

Share your subscription account access with others
12. Termination
We reserve the right to refuse service or terminate your access to our services at our discretion, including if we believe you have violated these Terms and Conditions. Upon termination, you will not be entitled to a refund for any unused services.
13. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. For subscription customers, we will provide 30 days' notice of material changes.
14. Dispute Resolution
14.1 Governing Law
These Terms and Conditions shall be governed by the laws of California/United States of America, without regard to conflict of law principles.
14.2 Dispute Resolution Process
In the event of any dispute, you agree to first contact us to attempt to resolve the issue informally. If we cannot resolve the dispute within 60 days, either party may pursue formal resolution.
14.3 Arbitration
Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if they qualify. The arbitration shall be conducted in San Luis Obispo County, California, and judgment on the arbitration award may be entered in any court having jurisdiction thereof.
15. Miscellaneous
15.1 Entire Agreement
These Terms and Conditions constitute the entire agreement between you and Hopeful Writing regarding our services.
15.2 Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these terms will not constitute a waiver of that right or provision.
15.4 Assignment
You may not assign or transfer these terms without our written consent. We may assign these terms without restriction.
